ABSTRACTGeorges Droz, former Secretary-General of the Hague Conference on Private International Law, starts by describing the notarial function both in countries that have a proper notarial system (countries known as belonging to the latin notarial system) and in those countries where, even if the institution is not very widespread, the notarial function is nevertheless exerted. The author then examines the domain of the international notarial activity and its consequences, namely the notary's responsibility in the application of choice-of-law rules and foreign laws. In the last part of his course, Mr. Droz examines the result of the international notarial activity, i.e. the condition of the notarial act or its equivalent in international relations: equivalence of instruments, evidence of their origin, their conclusive force, their obligatory force, their execution. The author wonders what the future will hold for the notarial act.
Georges Droz, ancien Secrétaire général de la Conférence de La Haye de droit international privé, commence par décrire la fonction notariale tant dans les pays qui connaissent l’institution notariale proprement dite (pays dits de notariat latin) que dans ceux où, si l’institution est peu répandue, le fonction notariale est néanmoins exercée. L’auteur étudie ensuite le domaine de l’activité notariale internationale et son corollaire, à savoir la responsabilité du notaire dans l’application des règles de conflits et des lois étrangères. M. Droz examine enfin le résultat de l’activité notariale internationale, c’est-à-dire le sort de l’acte notarié ou son équivalent dans les relations internationales : équivalence des instruments, preuves de leur origine, leur force probante, leur force obligatoire, leur exécution, et s’interroge sur ce que sera l’acte notarié de demain.
