ABSTRACTIn this course, Ibrahim Fadlallah discusses Arbitrator’s behavior in the face of a public policy rule. The course is an inquiry based on the methodical counting of many awards published mainly in the two collections of the International Chamber of Commerce, the Journal of International Law and the Yearbook of Commercial Arbitration as well as in the French Journal of Arbitration. After a brief introduction, the author presents the legal factors for the development of arbitration. As the arbitrator's reports with norms of public order are complicated, the author defines the function of public order in arbitration. It is possible to find out how the arbitrators actually behave with regard to a rule of public order. In this context, the author discusses the jurisdiction of the arbitrators with regard to public order. Finally, he deals with public policy in the substantive settlement of the dispute, focusing on areas in which the public order has directly influenced the solution and the manner in which it has been dealt with.
Dans ce cours, Ibrahim Fadlallah discute du comportement de l’arbitre face à une règle d’ordre public. Le cours est une enquête fondée sur le dépouillement méthodique des nombreuses sentences publiées principalement dans les deux recueils de la Chambre de commerce internationale, le Journal du droit international, le Yearbook of Commercial Arbitration et dans la Revue française de l’arbitrage. Après une brève introduction, l’auteur présente les facteurs juridiques du développement de l'arbitrage. Comme les rapports de l’arbitre avec les normes d’ordre public se compliquent, l’auteur défini la fonction de l’ordre public dans l’arbitrage. Dans ce contexte, l’auteur discute de la compétence des arbitres à l’égard d’une règle d’ordre public. Enfin, il traite de la politique publique dans le règlement du différend sur le fond, en se concentrant sur les domaines dans lesquels l'ordre public a directement influencé la solution et la manière dont elle a été traitée.
