ABSTRACTKarl Zemanek supports his presentation of modern problems of State succession on the analysis of relevant contemporary international practice. He attempts to isolate the typical forms of behavior and to measure the behavior according to the principles of international law for studying their legal meaning, since not all behaviors are custom creators. The author successively examines the succession in fact, succession to treaties, succession to membership of an international organization, succession to the public debt, and the effects of State succession on municipal law relationships.
Karl Zemanek appuie sa présentation des problèmes modernes de succession d'Etats sur l'analyse de la pratique contemporaine internationale pertinente. Elle tente d'isoler les formes typiques de comportement et de les mesurer à l'aune des principes de droit international pour en étudier leur signification juridique, puisque tous les comportements ne sont pas créateurs de coutume. L'auteur étudie successivement la succession dans les faits, la succession dans les traités, la succession en tant que membre d'une organisation internationale, la succession à la dette publique, et les effets de la succession d'Etats dans les relations de droit interne.
