ABSTRACTThe ever-increasing role played by the modern state in the economic life of any national society is one of the most remarkable phenomena of modern era. This phenomenon has led to fundamental transformations in various national systems. Fouad Riad explains that private international law, whose task is to ensure the parallel coexistence of these systems, was bound to be affected sooner or later. The author successively discusses the legal personality of the public enterprise at the international level, the participation or non-participation of the public enterprise in State immunity, the contractual activity of the public enterprise, and the liability of the public enterprise.
Le rôle sans cesse croissant joué par l'Etat moderne dans la vie économique de toute société nationale constitue l'un des phénomènes les plus remarquables de l'époque moderne. Ce phénomène a entraîné des transformations fondamentales dans les divers systèmes nationaux. Le droit international privé, dont la tâche est d'assurer la coexistence parallèle de ces systèmes, devait tôt ou tard, explique Fouad Riad, s'en trouver touché. L'auteur étudie successivement la personnalité juridique de l'entreprise publique sur le plan international, la participation ou la non-participation de l'entreprise publique à l'immunité de l'Etat, l'activité contractuelle de l'entreprise publique, et la responsabilité de l'entreprise publique.
