ABSTRACTMustafa Kamil Yasseen explains in the introduction to his course that the problems of the application of foreign law are not solved everywhere in the same way, which is, moreover, often in the same state, the solutions of the jurisprudence on this issue lack coherence and do not always seem to be dominated by a fundamental guiding idea. Perhaps too ingenious constructions in this field have removed us from reality; at least they have given us a completely artificial explanation. The author suggests that a simplification effort would be useful to bring us closer to reality. We must envisage this reality as it presents itself. Thus, the author successively examines: the Office of the judge in the application of foreign law and the proof of the right, the determination of the applicable foreign rules and their validity, the interpretation of foreign law and the qualification in order to apply a foreign rule, and the supplementation to the drawbacks to the foreign law.
Mustafa Kamil Yasseen explique en introduction de son cours que les problèmes que pose l'application du droit étranger ne sont pas résolus partout de la même manière, qui plus est, souvent, dans un même Etat, les solutions de la jurisprudence à cet égard manquent de cohérence et ne semblent pas toujours être dominées par une idée directrice fondamentale. Des constructions trop ingénieuses dans ce domaine nous ont peut-être éloignés de la réalité, au moins elles nous ont donné une explication toute artificielle. Un effort de simplification, préconise l'auteur, serait utile pour nous rapprocher de la réalité. Il faut envisager cette réalité en face telle qu'elle se présente. C'est ainsi que l'auteur étudie successivement : l'office du juge dans l'application du droit étranger et la preuve de ce droit, la détermination des règles étrangères applicables et leur validité, l'interprétation de la loi étrangère et la qualification en vue d'appliquer une règle étrangère, et la suppléance à la carence du droit étranger.
