ABSTRACTWilhelm Wengler begins his course on the General Principles of Private International Law with a presentation of the general principles of private international law: conflicts of laws and gaps between the conflicts of law. He examines the problems of "intergentil" laws and the solutions to the problems. The author discusses the question of interterritorial law and the possible methods of their solution. He examines the main possible legislative techniques under the allocation system, the principles of legislative policy for shaping of allocation rules, the question of renvoi and other forms of taking into account the result of foreign allocation rules, the consistency of legal situations in the legal system of the country of the forum as a factor influencing or correcting the allocation, the time element in allocation rules, the elimination of foreign rules by the public policy, the allocation rules in relations with the rules governing the recognition of foreign judgments, and the method of special rules in positive private international law.
Wilhelm Wengler commence son cours sur les principes généraux du droit international privé par une présentation des principes généraux de droit international privé : les conflits de lois et les divergences entre elles. Il étudie ensuite les problèmes des lois « intergentil » et les solutions qui peuvent leur être apportées. L'auteur aborde ensuite la question du droit interterritorial et des méthodes possibles pour les résoudre. Il examine ensuite les principales techniques législatives possibles dans le système d'attribution, les principes de politique législative pour la création de règles d'attribution, la question du renvoi et des autres formes de prise en compte du résultat des règles d'attribution étrangères, la cohérence des situations juridiques dans l'ordre juridique du pays du for en tant que facteur influençant ou corrigeant l'attribution, l'élément temporel dans les règles d'attribution, l'élimination des règles étrangères par le jeu de l'ordre public, les règles d'attribution dans leurs rapports avec les règles relatives à la reconnaissance des jugements étrangers, et la méthode des règles spéciales en droit international privé positif.
