ABSTRACTStarting from the idea that all jurists agree that the State is composed of three elements, namely a population, a territory, and a legal order or a political organization within which the human community governs itself freely without any other control or limitation than those of international law, Ricardo Alfaro begins his course on the Rights and Obligations of States by presenting the theory of fundamental rights of States. The author examines the notion of rights and duties in international law, the idea of codification of international law, and the possibility of a succinct declaration of principles. Finally, the author focuses on the codification work carried out in America and Europe, and on the formulation of a draft declaration of rights and duties.
Partant de l'idée que tous les juristes s'accordent pour dire que l'Etat est composé de trois éléments, à savoir une population, un territoire et un ordre juridique ou une organisation politique dans le cadre desquels la collectivité humaine se gouverne librement sans autre contrôle ou limitation que ceux du droit international, Ricardo Alfaro commence sur cours sur les droits et obligations des Etats par une présentation de la théorie des droits fondamentaux des Etats. Il étudie ensuite la notion de droits et obligations en droit international, puis l'idée de codification du droit international et la possibilité d'une déclaration de principes succincte. L'auteur s'intéresse ensuite aux travaux de codification menés en Amérique et en Europe, à la formulation d'un projet de droits et obligations.
