ABSTRACTIn his course, Manfred Lachs analyzes the circumstances in which the changes made by multilateral treaties in the institutions inherited from bilateral treaties have taken place, both in substance and in form. Indeed, the author notes that these two elements are integrally linked to each other. The contradiction between these two elements, or their harmonious cooperation, ultimately decides the role of a treaty, hence the opportunity of their confrontation with one another. What is the function of multilateral treaties in the modern world at a time when States with different political and social structures coexist? What are the trends in their evolution? These are the questions the author wishes to answer in his course.
Dans son cours, Manfred Lachs analyse les circonstances dans lesquelles ont eu lieu les changements opérés par les traités multilatéraux au sein des institutions héritées de traités bilatéraux tant en ce qui concerne le fond que la forme. En effet, relève l'auteur, ces deux éléments sont intégralement liés l'un à l'autre. La contradiction opposant ces deux éléments ou leur harmonieuse coopération décident, en fin de compte, du rôle d'un traité, d'où l'opportunité de leur confrontation avec la vie. Quelle est la fonction des traités multilatéraux dans le monde moderne à une époque où coexistent des Etats ayant des structures politiques et sociales différentes, quelles sont les tendances de leur évolution, voilà les questions auxquelles l'auteur souhaite répondre dans son étude.
