ABSTRACTCan and should atomic law be autonomous? asks R. E. Charlier in the introduction to his course. Or will the questions it raises, the solutions it calls for, have nothing specifically atomic about it? And are they revolutionary? "A new world of thinking has become necessary if we want to survive" (Einstein), is it also true about law? Some authors believe that every new fact calls for a new law and that atom imposes the upheaval of conceptions and patterns of law, especially in the international field. The truth is that the atomic field is not a universe apart, states the author. Mastering of an atom needs all disciplines and will enrich them all. The author successively exposes the following problems: the transition from atomic power to atomic service; atomic institutions; atomic intelligence; atomic properties; the proscription of weapons.
Le droit atomique peut-il et doit-il être autonome ? demande R. E. Charlier en introduction de son cours. Ou les questions qu'il soulève, les solutions qu'il appelle, n'auront-elles rien de spécifiquement atomique ? Et sont-elles révolutionnaires ? « Un nouveau monde de penser est devenu nécessaire si nous voulons survivre » (Einstein), cela est-il vrai du droit également ? Certains auteurs estiment que tout fait nouveau appelle un droit nouveau et que l'atome impose le bouleversement des conceptions et structures du droit, surtout dans le domaine international. En vérité, affirme l'auteur, le domaine atomique n'est pas un univers à part. La maîtrise de l'atome a besoin de toutes les disciplines et va les enrichir toutes. L'auteur expose successivement les problèmes suivants : le passage de la puissance atomique au service atomique ; les institutions atomiques ; l'intelligence atomique ; les biens atomiques ; la proscription de l'arme.
