ABSTRACTThe main subject of C. Wilfred Jenks' course is a particular experience in international action to protect the freedom of association of trade unions, which was undertaken by the International Labor Organization with considerable initial success in the years following 1947, notably through three conventions and fact-finding procedures. After a presentation of the origins of international action for the protection of freedom of association for trade union purposes, its scope and content, the author presents the ILO procedures for the protection of freedom of association. The author then focuses on case law of the Governing Body and evaluation of the ILO procedure.
L'objet principal du cours de C. Wilfred Jenks est une expérience particulière en matière d'action internationale pour la protection de la liberté d'association des syndicats qui a été entreprise par l'Organisation Internationale du Travail avec un succès initial considérable dans les années qui suivent 1947, grâce notamment à trois conventions et à des procédures d'établissement des faits. Après une présentation des origines de l'action internationale de protection de la liberté d'association à des fins syndicales, de sa portée et de son contenu, l'auteur présente les procédures de l'OIT pour la protection de cette liberté. Il s'intéresse ensuite à la jurisprudence du conseil d’administration, puis procède à une évaluation de la procédure de l'OIT.
