ABSTRACTIn his course on the Interaction of Public International Law and Private International Law, B. A. Wortley seeks to explain how the rules of these two branches of law are interlinked and how the growth of one branch can affect the other. The author offers a series of examples to illustrate his general thesis that public international law and private international law have much in common, their development can be studied in a comparative manner, the two systems interact with each other, and on occasion, the rules of one can correct the rules of the other, as in Roman law and English law equity has corrected traditional law.
Dans son cours sur l'interaction entre droit international public et droit international privé, B.A. Wortley veut essayer d'expliquer comment les règles de ces deux branches du droit sont liées les unes aux autres et comment la croissance des unes peut affecter les autres. L'auteur propose une série d'exemples lui permettant d'illustrer sa thèse générale que le droit international public et le droit international privé ont beaucoup en commun, que leur développement peut être étudié de manière comparée, que les deux systèmes interagissent entre eux et qu'à l'occasion, les règles de l'un peuvent corriger les règles de l'autre, comme dans le droit romain et le droit anglais l'équité est venue corriger le droit traditionnel.
