ABSTRACTJuraj Andrassy points out in the introduction to his course that if the international law contains provisions on the right of neighborhood in the sense of the mandatory rules applicable to cases of damage caused by cross-border facts, it must be recognized that these rules cover only a very modest field of application. They can only prevent or incapacitate certain harmful consequences. In the first part of his course devoted to international neighborhood law, the author raises the issue of the existence of the Law of the neighborhood, searches for sources of settlement, examines the basis of international law of the neighborhood, and then presents the rules of the neighborhood between States. In the second part devoted to the regulation of neighborhood relations, the author examines, after the presentation of general considerations, the sources of regulation, the special bodies, the delimitation of the border, the border zones, local border traffic, services between neighboring regions, easements between neighboring regions, and the shared water facilities.
Juraj Andrassy signale en introduction de son cours que si le droit international contient des dispositions concernant le droit de voisinage dans le sens des règles obligatoires applicables aux cas de dommage provoqué par des faits d'outre-frontière, il faut reconnaître que ces règles ne couvrent qu'un champ d'application très modeste. Elles ne peuvent qu'empêcher ou paralyser certaines suites nuisibles. Dans la première partie de son cours, consacrée au droit international de voisinage, l'auteur pose la question de l'existence du droit de voisinage, recherche les sources de règlement, étudie le fondement du droit international de voisinage, puis présente les règles de voisinage entre États. Dans la seconde partie, consacrée au règlement des relations de voisinage, l'auteur s'intéresse successivement, après la présentation de considérations générales, aux sources de règlement, aux organes spéciaux, au tracé de la frontière, aux zones de frontière, au petit trafic frontalier, aux services entre régions limitrophes, aux servitudes entre régions limitrophes, et aux aménagements des eaux communes.
