ABSTRACTThe purpose of Charles Rousseau’s course is to determine the characteristics of the State in the international order, that is, to identify, from the point of view of the law of nations, the essential characteristics by which a political community is or not recognized as a State. After a presentation of the concept of sovereignty and the traditional criterion of distinction between the State and other communities in the law of nations, the author examines international jurisprudence, the concept of independence, and attempts to construct a theory of independence in international law.
L'objet du cours de Charles Rousseau est de déterminer les caractères de l'État dans l'ordre international, c'est à dire de dégager, du point de vue du droit des gens, les caractères essentiels grâce auxquels on reconnaît ou non à une collectivité politique la qualité d'État. Après une présentation de la notion de souveraineté et du critère traditionnel de distinction entre l'État et les autres collectivités du droit des gens, l'auteur examine la jurisprudence internationale, la notion d'indépendance, et procède à un essai de construction d'une théorie de l'indépendance en droit international.
