ABSTRACTIn this course, Hans Lewald studies general problems concerning private international law. The author examines from the point of view of the legal technique, the specific subject of the private international law posing particular problems with regard to the formation and the application of the rules of law which compose the object. This examination allows the author to report on the specific nature of conflict of laws. The first part of the course is devoted to the structure of the conflict rule, the second part to the implementation of the conflict rule, and the third part to the application of the competent law.
Dans ce cours, Hans Lewald étudie les problèmes d'ordre général concernant le droit international privé. Il les examine au point de vue de la technique juridique, l'objet spécifique du droit international privé posant des problèmes particuliers en ce qui concerne la formation et l'application des règles de droit qui le composent. Cet examen permet à l'auteur de rendre compte de la nature spécifique des conflits de lois. La première partie du cours est consacrée à la structure de la règle de conflit, la deuxième à la mise en œuvre de la règle de conflit, et la troisième à l'application de la loi compétente.
