ABSTRACTPaul de La Pradelle, Honorary Professor at the Law School of Aix-Marseille, notes that territory-space conflicts, or territorial and spatial interests, concern complex situations to which actors and factors are difficult to find the solutions. In the introduction, the author recalls the fundamental principles generally accepted as being capable of establishing the respective definitions of the two concepts, examines the most significant conflicts involving them (in the new Law of the Sea and in the field of the peaceful uses of outer space), and then outlines the results and consequences of the conflicts in the perspective of a positive development of international law.
Paul de La Pradelle, professeur honoraire à la faculté de droit d'Aix-Marseille, note que les conflits territoire-espace, ou des intérêts territoriaux et spatiaux, concernent des situations complexes, dont les acteurs et les facteurs rendent leur solution malaisée. L'auteur rappelle en introduction les principes fondamentaux généralement acceptés comme étant de nature à établir les définitions respectives des deux concepts, étudie les conflits les plus marquants qui les mettent en cause (dans le nouveau droit de la mer et dans le domaine des utilisations pacifiques de l'espace extra-atmosphérique), puis en dégage les résultats et les conséquences dans la perspective d'une évolution positive du droit international.
