ABSTRACTGiovanni Maria Ubertazzi notes in his course that the principle of non-discrimination has not yet gained, in 1977, an important place in the doctrine of conflict of laws. In itself, this lack of interest is surprising, especially when one takes into account the very high level that scientific research has reached in the field of theory of law. To correct the existing situation, the author begins his course by explaining the process of the principle of non-discrimination through the texts and the language experts. He then examines the evolution of the doctrine of private international law with regard to the principle of non-discrimination. He also discusses the relations between conflict rules and the equality of basic situations, and the relations between conflict rules and inequality of treatment. Finally, the author focuses on the impact of prohibitions against discrimination in the field of private international law.
Giovanni Maria Ubertazzi relève dans son cours que le principe de non-discrimination n'a pas encore gagné, en 1977, une place importante dans la doctrine des conflits de lois. En soi, ce peu d'intérêt ne manque pas de surprendre, surtout si l'on tient compte du très haut niveau que la recherche scientifique a atteint dans cette branche de la théorie du droit. Pour réparer cet état de fait, l'auteur commence par exposer le cheminement du principe de non-discrimination à travers les textes et le langage des spécialistes. Il étudie ensuite l'évolution de la doctrine du droit international privé au sujet du principe de non-discrimination. Il aborde en outre la question des rapports des règles de conflit avec l'égalité des situations de base, puis celle des rapports des règles de conflit avec l'inégalité de traitement. Enfin, l'auteur s'intéresse aux retombées des interdictions de discriminer dans le domaine du droit international privé.
