ABSTRACTGaetano Arangio-Ruiz, Professor at the University of Rome, focuses on a dispute that has arisen since the conclusion of the Conference on Security and Cooperation in Europe, on the impact of the non-intervention principle on international rules for protection and promotion of human rights and fundamental freedoms, and more generally on international rules for humanitarian issues. The author first examines the question of human rights and self-determination in the Helsinki Final Act. He then focuses on the question of non-intervention by a State in the internal or external affairs of another State. He also examines the question of human rights in relation to sovereignty and the obligation of non-intervention States. Finally, he proposes some concluding remarks.
Le cours de Gaetano Arangio-Ruiz, professeur à l'Université de Rome, porte sur la querelle qui est apparue, depuis la conclusion de la Conférence sur la sécurité et la coopération en Europe, sur l'impact du principe de non-intervention sur les règles internationales de protection et de promotion des droits de l'homme et des libertés fondamentales, et plus généralement sur les règles internationales à caractère humanitaire. L'auteur étudie tout d'abord la question des droits de l'homme et de l'auto-détermination dans l'acte final d'Helsinki. Il s'interroge ensuite sur la question de la non-intervention par un Etat dans les affaires internes ou externes d'un autre Etat. Il examine également la question des droits de l'homme en lien avec la souveraineté et l'obligation des Etats de ne pas intervenir. Il propose enfin quelques remarques conclusives.
