ABSTRACTJohn Foster begins his course with some general considerations on the English theory of international law, based on international comity and reciprocity. The author then focuses on the English theory of domicile, the application of national law in the field of personal law in English private international law, the solution given to the problems of private international law raised by the political events of the time (1938) in England, state immunities, public policy, and English private international criminal law.
John Foster commence son cours en présentant quelques considérations générales sur la théorie anglaise du droit international, basée sur la courtoisie internationale (comity) et sur la réciprocité. L'auteur étudie ensuite la théorie anglaise du domicile, l'application du droit national en matière de droit des personnes en droit international privé anglais, la solution donnée en Angleterre aux problèmes de droit international privé soulevés par les événements politiques du jour (1938), les immunités d'État, l'ordre public, et le droit pénal international privé anglais.
