ABSTRACTGeorges Scelle points out in the introduction that the subject of this course is as vast as the international law itself, as it could be called: The effectiveness of the rule of law. At first, the author presents the theory of international legal order and social functions, and particularly the executive function. He then studies the control of the investiture of government functions, and particularly the issue of recognition. He later focuses on the issues of guarantee and prevention, the issues of the means of execution, and the issues of the procedure of the executive function.

Le sujet de ce cours, relève Georges Scelle en introduction, est aussi vaste que le droit international lui-même, car il pourrait s'intituler : De l'efficacité de la règle de droit. Dans un premier temps, l'auteur présente la théorie de l'ordre juridique international et des fonctions sociales, et notamment la fonction exécutive. Il étudie ensuite le contrôle de l'investiture des fonctions gouvernementales, et notamment la question de la reconnaissance. Il s'intéresse ensuite aux questions de la garantie et de la prévention, à celle des voies d'exécution, et à celle de la procédure de la fonction exécutive.
