ABSTRACTIn the introduction to his course, Karl Strupp makes the following observation: under the penalty of ad infinitum regression in legal order, it should be admitted that the foundation of international law is pre-legal. Ever since the States have recognized an obligatory nature of the international norms at different periods which could not be specified historically, it is that the same principle was a part of the public international law while retaining its illegal origin. It has become a customary international norm. After a long introduction, the author presents the problem of the sources of international law. He then studies the relationships of international law and domestic law, the subjects of the law of nations and the State as a subject of the law of nations, the Sate bodies and State agglomerations, population as an element of the State, territory of the State, international offence. Finally, he wonders if the rules of prophylactic law of war constitute the general rules of peace.
Dans l'introduction de son cours, Karl Strupp fait la constatation suivante : sous peine de régression ad infinitum dans l'ordre juridique, il faut admettre que le fondement du droit international est préjuridique. Dès lors que les Etats ont à des époques différentes que l'on ne pourrait préciser historiquement, reconnu le caractère obligatoire des normes internationales, c'est que ce même principe faisait partie du droit international public tout en gardant sa provenance ajuridique. Il est devenu une norme coutumière internationale. Après une longue introduction, l'auteur présente le problème des sources du droit international. Il étudie ensuite les rapports du droit international et du droit interne, les sujets du droit des gens et l'Etat en tant que sujet du droit des gens, les organes d'Etats et d'agglomérations d'Etats, la population comme élément de l'Etat, le territoire de l'Etat, le délit international. Enfin, il se demande si les règles du droit prophylactique de la guerre constituent des règles générales de la paix.
