ABSTRACTThe objective of Boris Mirkine-Guetzevitch’s course is to study the constitutional law of peace, that is, the study of the constitutional rules for the peace organization, the different forms by which the modern constitutional law can contribute to the consolidation of international peace. The author successively focuses on the internal guarantees of peace, the constitutional renunciation of war, the peace organization in its relations with political regimes, the Covenant of the League of Nations and the Briand-Kellogg Covenant, and finally on the problems of integration of the international rules of peace with the domestic public law mentioned at the Conference on Disarmament.
L'objet du cours de Boris Mirkine-Guetzévitch est l'étude du droit constitutionnel de la Paix, c'est-à-dire l'étude des règles constitutionnelles pour l'organisation de la paix, des différentes formes par lesquelles le droit constitutionnel moderne peut contribuer à la consolidation de la paix internationale. L'auteur s'intéresse successivement aux garanties internes de la paix, à la renonciation constitutionnelle à la guerre, à l’organisation de la paix dans ses rapports avec les régimes politiques, au Pacte de la Société des Nations et au Pacte Briand-Kellogg, et enfin aux problèmes de la mise en harmonie des règles internationales de la paix avec le droit public interne évoqués à la Conférence du Désarmement.
