ABSTRACTThe problem of succession of States in international law is one of the most serious problems of the general theory of the law of nations and one of the most important ones for international practice. After a few preliminary considerations on the succession to international rights and duties in general, the author addresses the issue of the succession of the States in international duties, other than public debts, according to international law. He then studies the non-delegable rights and duties and the problem of succession of States.
Le problème de la succession des Etats en droit international est, relève Manlio Udina, l'un des problèmes les plus graves de la théorie générale du droit des gens et l'un des plus importants pour la pratique internationale. Après quelques considérations préliminaires sur la succession aux droits et obligations internationaux en général, l'auteur aborde la question de la succession des Etats dans les obligations internationales, autres que les dettes publiques, d'après le droit international. Il étudie ensuite les droits et obligations intransmissibles et le problème de la succession des Etats.
