ABSTRACTThe task which Frede Castberg assigns to himself in this course is to explain the nature and the method of legal reasoning, by particularly considering the problems posed by reasoning in the domain of public international law. The author thus successively studies: the logical nature of legal proposition; the application of treaty provisions and the customary rules of law; the solution of the legal issues, which are not resolved by the treaty and customary rules; the contribution of the theory to the development of international law.
La tâche que s'assigne Frede Catsberg dans ce cours est d'expliquer la nature et la méthode du raisonnement juridique, en tenant compte particulièrement des problèmes que ce raisonnement soulève dans le domaine du droit international public. L'auteur étudie ainsi successivement : le caractère logique de la proposition juridique ; l'application des dispositions conventionnelles et des règles de droit coutumières ; la solution des questions juridiques qui ne sont pas résolues par des règles conventionnelles et coutumières ; l'article 38 du Statut de la Cour permanente de Justice internationale ; la contribution de la théorie au développement du droit international.
