ABSTRACTThere are a very few problems, observes Hans Sperl in the introduction to the course, which present as many difficulties as the Recognition and Enforcement of Foreign Judgments. After a presentation of general principles, the author outlines a plan for a further development of the international recognition of judicial judgments and the observation and enforcement of judicial judgments abroad. The author provides effective principles of a new international law in the historical framework of ancient international law.
Il est bien peu de problèmes, relève Hans Sperl en introduction de son cours, qui présentent autant de difficultés que celui de la reconnaissance et de l'exécution des jugements étrangers. Après l'exposé de principes généraux, l'auteur trace le plan d'un développement ultérieur de la reconnaissance internationale des sentences judiciaires et de leur observation et exécution à l'étranger. Il entend en effet poser des principes féconds d'un droit international nouveau dans le cadre historique du droit international ancien.
