ABSTRACTJames W. Garner, in the introduction to his course, states that the most striking fact in the history of international law from its origin, which goes back more than three centuries, is its extraordinary development at the beginning of the XXth century. It is not a period of our history, not even the period of Grotius, that has seen changes of such scope on their relationships of States and in the law which governs them just as much as the present, writes the author. To give an account of this evolution, the author studies the effects of the Great War on international law, the extent of the field of international law (international legislation), the new international treaty law, the contribution of judicial and arbitral tribunals, the results of the movement for codification, and a few current trends.
James W. Garner affirme en introduction de son cours que le fait le plus frappant dans l'histoire du droit international depuis son origine, qui remonte à plus de trois siècles, est son développement extraordinaire au début du XXe siècle. Il n'est pas une période de notre histoire, écrit-il, pas même l'époque de Grotius, qui ait vu autant que la présente des changements d'une telle portée dans les relations des Etats et dans le droit qui les gouverne. Pour rendre compte de cette évolution, l'auteur étudie les effets de la Grande Guerre sur le droit international, l'extension du domaine du droit international (la législation internationale), le nouveau droit international conventionnel, la contribution des tribunaux judiciaires et arbitraux, les résultats du mouvement pour la codification, et quelques tendances actuelles.
