ABSTRACTAccording to the doctrine of non-justiciable disputes and the condition of the specific nature of international conflicts and international relations, there are certain types of dispute, the subject matter of which is not amenable to judicial settlement as a consequence of an obligation entered in advance into the context of compulsory arbitration. The purpose of H. Lauterpacht's study is to examine the extent to which it is possible to defend this aspect of the doctrine of sovereignty as a legal proposition.
D'après la doctrine des différends non justiciables, il est, à raison de la nature propre des conflits internationaux et des relations internationales, certains types de différends dont la matière n'est pas susceptible d'un règlement judiciaires qui soit la conséquence d'une obligation souscrite à l'avance dans le cadre de l'arbitrage obligatoire. Le but de l'étude de H. Lauterpacht est d'examiner jusqu'à quel point il est possible de défendre cet aspect de la doctrine de la souveraineté, en tant que proposition juridique.
