ABSTRACTAfter a general introduction to the principal provisions of the Convention on the Settlement of Foreign Investment Disputes, the history of the convention, and some distinctive features, Aron Broches presents the jurisdiction of International Centre for Settlement of Investment Disputes. He then focuses on the question related to a relationship between the Convention and diplomatic protection. He also focuses on the applicable law whether it is substantive law or procedural law. He then shows the characteristics of the arbitration award, in particular with regard to its purpose and its binding character.
Après une introduction générale consacrée aux dispositions principales de la Convention sur le règlement des différends relatifs aux investissements étrangers, à son histoire, et à certaines de ses caractéristiques, Aron Broches expose les compétences du CIRDI. Il présente ensuite la question des rapports entre la Convention et la protection diplomatique. Il s'intéresse également au droit applicable, qu'il s'agisse du droit matériel ou du droit procédural. Il expose ensuite les caractéristiques de la sentence arbitrale, notamment en ce qui concerne sa finalité et son caractère contraignant.
