ABSTRACTAlgot Bagge explains in the introduction to his course that the issue of conflicts of law in sales contracts is one of the most difficult issues in private international law, not only because international trade is likely to cause many complications, but also - and perhaps most importantly - because this subject is one of the least studied parts of a difficult science. After a study of the historical evolution and the legal basis of private international law, the author successively analyzes the question of public policy, the autonomy of the parties, and the special rules on the capacity of the parties, the form of the contract, and the liberating prescription. He then focuses on the rules normally applicable to sales contracts of tangible personal property, the risk transfer, questions of qualification, renvoi, and the obligation of the court to apply the private international law ex officio. He later presents the reform projects.
Algot Bagge explique en introduction de son cours que la question des conflits de lois en matière de contrats de vente est l'une des plus ardues du droit international privé, non seulement parce que le commerce international est susceptible de provoquer de nombreuses complications, mais aussi – et peut-être surtout – parce que ce sujet constitue une des parties les moins étudiées d'une science difficile. Après une étude de l'évolution historique et du fondement juridique du droit international privé, l'auteur analyse successivement la question de l'ordre public, celle de l'autonomie des parties, et les règles spéciales sur la capacité des parties, la forme du contrat et le prescription libératoire. Il s'intéresse ensuite aux règles normalement applicables aux contrats de vente de biens meubles corporels, au transfert du risque, aux questions de la qualification, du renvoi, et de l'obligation du tribunal d'appliquer d'office le droit international privé. Il présente ensuite des projets de réforme.
