ABSTRACTThe problem of effects produced on the life of a treaty by a fundamental and unforeseen change in the circumstances prevailing at the time of conclusion of treaty is one of the oldest questions in international law. This problem is taken into account in the treaties using the rebus sic stantibus clause. The objective of the course of Gyoergy Harszti, Professor at the Faculty of Law at the University of Budapest, is to examine the place of the rebus sic stantibus clause in international law (in 1975) and how the clause content can be applied to treaties. He also provides an account of the historical formation of the rebus sic stantibus clause.
Le problème des effets produits sur la vie d'un traité par un changement fondamental et imprévu des circonstances qui prévalaient au moment de la conclusion du traité est l'une des questions les plus anciennes du droit international. Ce problème est pris en compte dans les traités par la clause rebus sic stantibus. L'objectif que se donne dans ce cours György Harszti, professeur à la faculté de droit de l'Université de Budapest, est d'examiner la place qu'occupe cette clause dans le droit international (en 1975) et comment son contenu peut être appliqué aux traités. Il présente également un exposé de la formation historique de la doctrine rebus sic stantibus.
