ABSTRACTIn this course, Alexandre N. Sack intends to elucidate the historical evolution and the general principles of the institution of law that is the succession to the state public debts. After the first part devoted to the legal nature of the State public debts, the author focuses on the succession to the state public debts in the event of political transformation of the State, and then in the event of territorial transformation of the State. In this framework, the author studies the theories that deny the principle of the succession and those which affirm it.
Dans ce cours, Alexandre N. Sack entend élucider l'évolution historique et les principes généraux de cette institution de droit qu'est la succession aux dettes publiques d'Etat. Après une première partie consacrée à la nature juridique des dettes publiques d'Etat, l'auteur s'intéresse à la succession aux dettes publiques d'Etat en cas de transformation politique de l'Etat, puis en cas de transformation territoriale de l'Etat. Il étudie dans ce cadre les théories qui nient le principe d'une telle succession et celles qui l'affirment.
