ABSTRACTCharles De Boeck recalls that deportation is the act by which a State imposes and, if necessary, forces one or more individuals on its territory to leave the state within a short period of time. This measure cannot, in principle, apply to nationals. The author begins his study of the international difficulties raised by the practice of deportation by addressing the issue of the legal basis for the possibility of deportation. The author then examines the causes of deportation, the effects of deportation, and possible sanctions for unjustified deportation (whether illegal, vexatious or arbitrary).
L'expulsion, rappelle Charles De Boeck, est l'acte par lequel un Etat somme et au besoin contraint un ou plusieurs individus se trouvant sur son territoire d'en sortir dans un bref délai. Cette mesure ne peut, en principe, s'appliquer aux nationaux. L'auteur commence son étude des difficultés internationales que soulève la pratique de l'expulsion en abordant la question du fondement juridique de la faculté d'expulsion. Il s'intéresse ensuite aux causes d'expulsion, aux effets de l'expulsion, et aux sanctions possibles d'une expulsion injustifiée (qu'elle soit illégale, vexatoire ou arbitraire).
