ABSTRACTIn his course on the Antagonism Between Legal Security and Search for Justice in the Field of Contracts, F. Vischer, Professor at the University of Basel, first suggests an approach to conflicts of law that puts the individual’s interests. This objective could be called as an international principle of confidence, and could be applied specifically in the field of contracts in which by definition only the interests of parties are at stake.

Dans le cours qu'il consacre à l'antagonisme entre sécurité juridique et recherche de justice dans le domaine des contrats, F. Vischer, professeur à l'Université de Bâle, suggère en matière de conflits de lois une approche qui mette au premier plan les intérêts de l'individu. Cet objectif pourrait être nommé le principe international de confiance, et pourrait plus spécialement s'appliquer dans le domaine des contrats, dans lequel par définition seuls les intérêts des parties sont en jeu.
