ABSTRACTSir Cecil Hurst devotes this course to the study of the modern practice (in 1926) of States in the protection of diplomatic agents. After a reminder of the recent origin of the fixed embassies, the author examines the issue of the legal basis of diplomatic immunities and of the persons entitled to diplomatic immunity. The author then focuses on the exemption from criminal jurisdiction, immunity from civil jurisdiction, waiver of diplomatic immunity, domestic servants, the means to be used to obtain satisfaction from a diplomatic agent, the right to asylum, the situation of diplomatic agents in foreign countries except the one in which they are on mission, diplomatic immunities in time of war, and the period of time of diplomatic immunities.
Sir Cecil Hurst consacre ce cours à l'étude de la pratique moderne (en 1926) des États en matière de protection des agents diplomatiques. Après un rappel de l'origine récente des ambassades fixes, l'auteur aborde la question du fondement juridique des immunités diplomatiques, puis celle des personnes qui ont droit à l'immunité diplomatique. Il s'intéresse ensuite à l'exemption de la juridiction criminelle, à l'immunité de la juridiction civile, à la renonciation à l'immunité diplomatique, aux domestiques, aux moyens à employer pour obtenir satisfaction d'un agent diplomatique, au droit d'asile, à la situation des agents diplomatiques dans les pays étrangers autres que celui où ils sont en mission, aux immunités diplomatiques en temps de guerre, et à la durée des immunités diplomatiques.
