ABSTRACTIn the introduction to his course, O. Nippold emphasizes that for the historical study of international law, space and time play a role as insignificant as religious, political, and other considerations, or as the differences in civilization. From this point of view, the historical examination carried out by O. Nippold does not set any limitations at all. Indeed, international law requires "sub specie aeternitatis" to be studied. It is a right that exists throughout history and within all civilizations. After some general considerations on the history of the Law of Nations, the author examines the principles of the 19th century politics and their importance for the development of international law, the guiding principle of the 19th century law and the basis of the law, the positive developments in the Law of Nations during the 19th century, The Hague conferences and the League of Nations, the problem of international organization, and the future of the Law of Nations.
En introduction de son cours, O. Nippold souligne que pour l'étude historique du droit international, l'espace et le temps jouent un rôle aussi insignifiant que les considérations d'ordre religieux, politiques et autres, ou les différences de civilisation. A ce point de vue, l'examen historique mené par O. Nippold ne se fixe absolument aucune limitation. En effet, le droit international demande d'être étudié sub specie aeternitatis. C'est un droit qui a existé de tout temps et au sein de toutes les civilisations. Après quelques considérations générales sur l'histoire du droit des gens, l'auteur étudie les principes de la politique du XIXe siècle et leur importance pour le développement du droit international, le principe dirigeant du droit des gens au XIXe siècle et la base de ce droit, les progrès positifs du droit des gens au cours du XIXe siècle, les Conférences de La Haye et la Société des Nations, le problème de l'organisation internationale et l'avenir du droit des gens.
