ABSTRACTThe reciprocity in international law refers to the dependence of State’s treatment of problems of private international law in its territory on the treatment given by foreign States to identical problems in their territory. This is, for example, the attitude of State to recognize the effect of judgments given in a Foreign State only if its own judgement is recognized in the foreign state. Paul Lagarde intends to investigate in his course whether the concept of reciprocity which is, in a certain way, only the noble face of a more vulgar reality that would be haggling, has its place, and if so, what place, when the problem raised is not, in any case directly, a problem of relations between the states, but a problem related to the legal situation of a private person lost in “international trade” lato sensu.
La réciprocité en droit international désigne le fait pour un État de faire dépendre le traitement qu'il donnera aux problèmes de droit international privé qui se posent dans son territoire du traitement donné par les États étrangers à des problèmes identiques qui se posent dans leur territoire. C'est par exemple l'attitude consistant pour un État à ne reconnaître effet aux jugements rendus dans un État étranger que si effet est reconnu à ses propres jugements dans cet état étranger. Paul Lagarde entend rechercher dans son cours si la notion de réciprocité qui n'est, d'une certaine façon, que la face noble d'une réalité plus vulgaire qui serait le marchandage, a sa place, et dans l'affirmative, quelle place, lorsque le problème posé n'est pas, en tout cas pas directement, un problème de rapports entre États, mais un problème concernant la situation juridique d'une personne privée égarée dans le « commerce international » lato sensu.
