ABSTRACTIbrahim Shihata, Vice-President and General Counsel at the World Bank, proposes in his course a systematic study of the Multilateral Investment Guarantee Agency (MIGA) and its role in the legal treatment of foreign investment. After a historical review of the establishment of the agency, the author examines the conditions of eligibility of the investment guarantees proposed by MIGA. He then focuses on the management of guarantee agreements. The following chapter is devoted to the study of MIGA and the standards applicable to foreign investment. The final chapter deals with the role of MIGA in the resolution of disputes.
Ibrahim Shihata, Vice-President et General Counsel à la Banque mondiale, propose dans son cours une étude systématique de l’Agence multilatérale de garantie des investissements (MIGA) et de son rôle dans le traitement juridique des investissements étrangers. Après un rappel historique de la création de l’agence, l’auteur étudie les conditions de l'éligibilité de l'investissement aux garanties proposées par la MIGA. Il s’intéresse ensuite à la gestion des contrats de garantie. Le chapitre suivant est consacré à une étude de la MIGA et des standards applicables aux investissements étrangers. Le dernier chapitre concerne le rôle de la MIGA dans le cadre de la résolution des différends.
