ABSTRACTIn his course, Peter D. Trooboff, who works for Covington & Burling in Washington, comments on the case law of the United States of America with respect to some key issues arising in the field of state immunity, and relates the case law to the treatment of the issues in national or international codifications. The author points out that there is a significant consensus in the case law and state practice with respect to state immunity, and then examines the content of this consensus. He is also interested in the current codification efforts developed in this area by the International Law Commission. He demonstrates that a codification could now address certain procedural issues related to State immunity.

Trooboff, qui travaille chez Covington & Burling à Washington, commente la jurisprudence des Etats-Unis d’Amérique en ce qui concerne certains éléments clefs surgissant dans le domaine de l’immunité d’État, et établit un lien entre cette jurisprudence et le traitement de cette même question dans les codifications nationales ou internationales. L’auteur fait tout d’abord le constat qu’il existe un consensus important dans la jurisprudence et la pratiques étatiques en ce qui concerne l’immunité d’État, et étudie ensuite le contenu de ce consensus. Il s’intéresse également aux efforts actuels de codification développés en ce domaine par la Commission du droit international. Il démontre ensuite qu’une codification pourrait dès maintenant viser certaines questions procédurales relatives à l’immunité d’État.
