ABSTRACTAubrey L. Diamond, Director of the Institute of Advanced Legal Studies at the University of London, devotes his course to the harmonization of private international law with regard to contractual obligations. After an introduction essentially devoted to the harmonization of law - and in particular private international law - the author discusses the issues of freedom of choice applicable to the contract. He focuses on the situation in which no choice has been made. Aubrey L. Diamond examines the issue of the relationship between freedom of choice and the effect of peremptory norms. Finally, the author analyzes some special rules (including rules concerning consumer protection or employment contracts).

Diamond, directeur de l’Institute of Advanced Legal Studies de l’Université de Londres, consacre son cours à l’harmonisation du droit international privé en ce qui concerne les obligations contractuelles. Après une introduction essentiellement consacrée à l’harmonisation du droit – et notamment du droit international privé – l’auteur aborde la question de la liberté du choix applicable au contrat. Il s’intéresse ensuite à la situation dans laquelle aucun choix n’a été fait. Aubrey L. Diamond étudie ensuite la question de la relation entre la liberté de choix et l’effet des normes impératives. Enfin, l’auteur analyse certaines règles spéciales (notamment celles concernant la protection du consommateur ou celles visant les contrats de travail).
