ABSTRACTStanislaw Soltysinsky, Professor at the Mickiewicz University of Poznan, assigns a double objective to his course on the choice of applicable law and competent court in transnational transfer of technology transactions. On one hand, he analyzes recent legal developments in relevant fields, based on illustrations from developed countries and developing countries. On the other hand, the objective of this course is to identify the real socio-economic reasons that support various legal solutions. Professor Sołtysinsky focuses, in the first chapter, on the choice of applicable law (and in particular its limitations), and, in the second chapter, on the choice of the competent court.
Stanisław Sołtysińsky, professeur à l’Université Mickiewicz de Poznań, assigne un double objectif à son cours sur le choix du droit applicable et de la juridiction compétente dans les transactions transnationales de transfert de technologie. D’une part, il procède à l’analyse de développements juridiques récents intervenus dans des domaines pertinents, et cela à partir d’illustrations provenant de pays développés et de pays en développement. Le second objectif de ce cours est d´autre part d’identifier les véritables raisons socio-économiques qui soutiennent les diverses solutions juridiques. Le professeur Sołtysińsky s’intéresse dans un premier chapitre au choix du droit applicable (et notamment à ses limitations), et dans un deuxième chapitre au choix de la juridiction compétente.
