ABSTRACTIn his course on International Civil and Commercial Legal Mutual Assistance, Octavian Capatina, like Rabelais, intends to "break the bone to suck out the substantial marrow". For this purpose, the author begins by clarifying the meaning, so controversial, of the concept of international legal assistance and identifies the regulations applied to it. He then discusses and separately analyzes the common features of the relevant proceedings.
Dans son cours sur l'entraide judiciaire internationale en matière civile et commerciale, Octavian Capatina entend, à l'instar de Rabelais « rompre l'os pour sucer la substantifique moelle ». A cette fin, l'auteur commence par éclaircir le sens, si controversé, de la notion d'entraide judiciaire internationale et identifie les réglementations qui y sont applicables. Il aborde ensuite les traits communs des procédures en question pour les analyser ensuite séparément.
