ABSTRACTThe course of Jean Salmon, Director of the Institute of Sociology of the Université libre de Bruxelles, is devoted to the study of fact in the application of law. The author intends to analyze the role of juridical fact when international law is applied to an actual situation. If various moments or forms of legal reasoning have already been studied, the author does not believe that a synthesis has been attempted for public international law. In the first part, Professor Salmon presents the different stages of legal reasoning (the major or juridical fact in the rule of law, the minor or the law in the juridical fact, the interpretation of the law or the major under the test of the minor), and in the second part he examines the competence to implement the law.
Le cours de Jean Salmon, directeur de l'Institut de sociologie de l'Université libre de Bruxelles, est consacré à l'étude du fait dans l'application du droit. L'auteur entend analyser le rôle du fait dans le raisonnement du juriste lorsqu'il applique le droit international à une situation concrète. Si divers moments ou formes du raisonnement juridique ont déjà été étudiés, l'auteur ne pense pas qu'une synthèse ait été tentée pour le droit international public. Dans une première partie, le Professeur Salmon s'attache à présenter les différents stades du raisonnement juridique (la majeure ou le fait dans la règle de droit, la mineure ou le droit dans le fait, l'interprétation du droit ou la majeure à l'épreuve de la mineure), et dans la deuxième partie il étudie la compétence pour appliquer le droit.
