ABSTRACTIn this course, Jean-Pierre Cot first examines whether the issue of ethics of the international trial is a problem or a subject of study. International justice is fallible human justice and involves its share of errors, uncertainties and fraud. Ad hoc judges are appointed by the parties to the trial and inevitably have contact with “their” party before their appointment even though they did not participate in the strictly judicial aspect of the case. The author says that in order to guarantee the independence of the judges, the International Court of Justice has issued rules on the incompatibility of external activities. However, a judge cannot participate in arbitration in a case that may subsequently come before the International Tribunal for the Law of the Sea. The author also points out that there is no procedure to state the facts and draw the consequences and indicates that the international court does not endorse fraud as such.
Dans ce cours, Jean Jean-Pierre Cot examine d'abord si la question de l'éthique du procès international est un problème ou un sujet d'étude. La justice internationale est une justice humaine, faillible et implique sa part d’erreurs, d’incertitudes, de fraude. Les juges ad hoc sont désignés par les parties au procès et ont inévitablement des contacts avec « leur » parti avant leur nomination, alors même qu’ils n’ont participé à l’aspect proprement judiciaire de l’affaire. L’auteur dit que pour garantir l’indépendance des juges, la Cour internationale de Justice a édicté des règles d’incompatibilité d’activités extérieures. Toutefois, un juge ne peut pas participer à un arbitrage dans une affaire susceptible de venir par la suite devant le Tribunal international du droit de la mer. L'auteur souligne également manque une procédure pour exposer les faits et en tirer les conséquences et indique que juridiction internationale ne sanctionne pas la fraude en tant que telle.
