ABSTRACTThe rejection of unconstitutional change of government is increasingly evident at the international level. At the universal level, international law in this regard remains embryonic; the normative framework has advocated indifference before emerging towards a universal mechanism that enshrines the rule of law and democracy. The birth of democratic legitimacy, and thus the surpassing of the principle of constitutional autonomy, is evolving towards the recognition of the free choice by the people of their political system.Regional rights, studied in the second part, have provided a different normative framework on the issue, also in the continents most marked by unconstitutional changes, with the example of the African Union. The course also reviews the condemnation of unconstitutional changes of government in other regional organizations, before delving into the reactions of these different regional organizations to these changes.
RÉSUMÉLe refus du changement anticonstitutionnel de gouvernement se manifeste de plus en plus au niveau international. Au niveau universel, le droit international dans ce domaine reste embryonnaire ; le cadre normatif a prôné l’indifférence avant d’émerger vers un dispositif universel qui consacre l’état de droit et la démocratie. La naissance de la légitimité démocratique, et ainsi le dépassement du principe d’autonomie constitutionnelle, évolue vers la reconnaissance du libre choix par le peuple de son système politique.Les droits régionaux, étudiés en deuxième partie, ont donné un cadre normatif différent sur la question, aussi dans les continents les plus marqués par les changements anticonstitutionnels, avec l’exemple l’Union Africaine. Le cours passe aussi en revue la condamnation de changements anticonstitutionnels de gouvernement dans les autres organisations régionales, avant d’approfondir les réactions de ces différentes organisations régionales face à ces changements.
