ABSTRACTIn this course, the author examines the theoretical and practical problems involved in the application of international law in domestic law. A special focus is given to the concept of the direct applicability or self-executing character of international law in domestic law. The doctrine of self-executing treaties in the United States is first examined, followed by the direct effect of European Union law. A framework of analysis is offered concerning the domestic application of international law by giving details on the concept of direct applicability of international law and its criteria. The last part of the course is related to the direct applicability of customary international law and acts of international organizations, and the direct enforceability of judgments of international courts.
RÉSUMÉDans ce cours, l'auteur examine les problèmes théoriques et pratiques liés à l'application du droit international en droit interne. Une attention particulière est accordée à la notion d'applicabilité directe ou de caractère auto-exécutoire du droit international en droit interne. La doctrine des traités d'auto-exécution aux États-Unis est d'abord examinée, puis l'effet direct du droit de l'Union européenne. Un cadre d'analyse est proposé concernant l'application interne du droit international en donnant des détails sur le concept d'applicabilité directe du droit international et ses critères. La dernière partie du cours est liée à l'applicabilité directe du droit international coutumier et des actes des organisations internationales, et à l'applicabilité directe des jugements des tribunaux internationaux.
