ABSTRACTThis lecture has three parts, the first one is dedicated to the concept of “narrative norms” and its position within the system of sources of private international law. Narrative norms are different types of norms, laws, principles, that “talk”, they are describing policies. When it comes to applying a law that has been determined, narrative norms play a role to favor of a certain outcome. The second part of the course deals with art law as a new field at the borderline between public and private international law, as public international law has an impact on the private affair, and conflict of law has put in place special rules for art. Finally, in the third part, the author shows the role of narrative norms in international art law for the recovery of art objects, the restitution of confiscated artworks, and ends by wondering about the conflict of narrative norms.
RÉSUMÉCe cours comporte trois parties, la première est consacrée au concept de "normes narratives" et à sa place dans le système des sources de droit international privé. Les normes narratives sont différents types de normes, de lois, de principes, qui "parlent", elles sont des politiques descriptives. Lorsqu'il s'agit d'appliquer une loi qui a été déterminée, les normes narratives jouent un rôle en faveur d'un certain résultat. La deuxième partie du cours traite du droit de l'art comme un nouveau domaine à la frontière entre le droit international public et le droit international privé, car le droit international public a un impact sur l'affaire privée, et le conflit de lois a mis en place des règles spéciales pour l'art. Enfin, dans la troisième partie, l'auteur montre le rôle des normes narratives dans le droit international de l'art pour la récupération des objets d'art, la restitution des œuvres d'art confisquées, et termine en s'interrogeant sur le conflit des normes narratives.
