ABSTRACTStarting with an overview of international economic relations and foreign investments, this course aims to understand State contracts and international arbitration. It shows reflection on two main points that are essential to State contracts in private international law: the law serving as lex fori, and the legal order providing the “conflict of law rules” determining rules that govern the substance of the contracts. The fact that companies can be subjects of public international law is weighed, and public international law is also to be considered for the lex fori of arbitration. The course follows with discussing the conflict of law rules that arbitrators have to apply, and legal rules governing the substance of the State contract. It concludes with a chapter dedicated to the International Centre for the Settlement of Investments Disputes (ICSID).
RÉSUMÉEn commençant par un aperçu des relations économiques internationales et des investissements étrangers, ce cours vise à comprendre les contrats d'État et l'arbitrage international. Il propose une réflexion sur deux points essentiels des contrats d'État en droit international privé : la loi qui sert de lex fori et l'ordre juridique qui fournit les « règles de conflit de lois » déterminant les règles qui régissent la substance des contrats. Le fait que les entreprises peuvent être des sujets de droit international public est pris en compte, et le droit international public doit également être pris en considération pour la lex fori de l'arbitrage. Le cours se poursuit par une discussion sur les règles de conflit de lois que les arbitres doivent appliquer, et les règles juridiques régissant la substance du contrat d'État. Il se termine par un chapitre consacré au Centre international pour le règlement des différends relatifs aux investissements (CIRDI).
