ABSTRACTThis course is devoted to the public order exception, and first, to the construction of the paradigm of international substantive regularity. The notions relating to the public policy exception and the regularity of foreign law are approached from the perspective of private international law. This course is divided into a first part on the international regularity of foreign law and a second part on the substantial regularity of the latter. The Professor then devotes himself to the paradigm of international substantive regularity and the clarification of public policy, as it is revealing of the nature of the public policy exception. Taking into account the composition of public policy is a condition of international substantial regularity of the competent foreign law. Finally, it is explained how international substantial regularity differs from the laws of police and international public policy.
RÉSUMÉCe cours est consacré à l’exception d’ordre public, et d’abord, à la construction du paradigme de la régularité substantielle internationale. Les notions relatives à l’exception d’ordre public et la régularité de la loi étrangère sont abordées sous l’angle du droit international privé. Ce cours est divisé en une première partie sur la régularité internationale du droit étranger puis une seconde partie sur la régularité substantielle de ce dernier. Le Professeur se consacre ensuite au paradigme de la régularité substantielle internationale et la clarification de l’ordre public, car elle est révélatrice de la nature de l’exception d’ordre public. La prise en compte de la composition de l’ordre public est une condition de régularité substantielle internationale de la loi étrangère compétente. Enfin, il est expliqué comment la régularité substantielle internationale se distingue des lois de police et de l’ordre public international.
