ABSTRACTThe notion of disaster, in the context of this course, is taken in a broad sense, taking the definitions proposed by the Institute of International Law and by the Research Centre for International Law in The Hague. The course is divided into two themes of study, disasters in peacetime and disasters in wartime. In the first part, relating to peacetime, the actors of humanitarian relief and the legal norms applicable to them are examined. In the second part, relating to wartime, a chapter is devoted to the legal regimes for the protection of victims. Then, the concept of the responsibility to protect is analyzed, and finally, the notion of transitional justice is discussed.
RÉSUMÉLa notion de catastrophe, dans le cadre de ce cours, est prise au sens large, en prenant les définitions proposées par l’Institut de Droit International et par le Centre de recherche de droit international de La Haye. Le cours se divise en deux thèmes d’études, les catastrophes en temps de paix et les catastrophes en temps de guerre. Dans la première partie, relative au temps de paix, sont examinés les acteurs du secours humanitaire ainsi que les normes juridiques qui leur sont applicables. Dans la seconde partie, relative au temps de guerre, un chapitre est consacré aux régimes juridiques de protection des victimes. Ensuite, le concept de responsabilité de protéger est analysé, pour finir sur la notion de la justice en transition.
