ABSTRACTIn this course, H. Patrick Glenn examines the so-called classical logic of private international law and reflects on the consequences of logic for private international law. He discusses the history of conflict of laws and the history of the conciliation of laws. The author discusses the conflict of laws and rules of private international law and examines the decline in the role of the rules. He continues with a note on the decline by examining the influence of general clauses and methods of interpretation on the functioning of the rules. The author also examines the tendency to relegate the localization rules to a secondary role and then the tendency to eliminate the location rules more drastically. The material choice that precedes or controls any process of choice of an applicable law, and the process of reconciliation of the respective roles of the legislator, jurisprudence, doctrine and practice, and the choice of material solutions, are discussed. The author concludes with an overview of the implementation of new forms of collaboration and reconciliation of jurisdiction and the need for conciliation of State laws and non-State laws.
RÉSUMÉLa conciliation des lois est une problématique datant de l’interdépendance des États et favorise le développement du droit international privé. Les différentes logiques et surtout l’histoire de ce droit permettent de comprendre l’émergence de la conciliation des lois. Les règles de localisations, par le conflit de loi, l’interprétation et la désintégration, mais aussi les règles matérielles de localisation, ont toutes un lien avec la conciliation. Le choix matériel est aussi une problématique de la conciliation.Ce cours se termine par trois chapitres sur les différentes formes de conciliation : la conciliation des rôles, la conciliation des compétences et la conciliation des lois étatiques et non-étatiques.
