ABSTRACTIn this course, Serge Sur focuses on the principle of confronting the letter or forms of expression of international law with its spirit, objectives, and aims. The author clarifies the meaning of the term "existence" in international law. He focuses on the evolution of international law and the legal consistency of the existence of international law. The author discusses the foundations of international law so as to understand the origin, autonomy, and unity of international law. He also deals with a controversial principle of international law, sovereignty, and the most visible part of international law, international treaties. The focus then shifts to the subject of creativity of conventional law and to the relationship between custom and the written law. The relationship between codification and progressive development and their relationship with the international custom are discussed. The international regime of unilateral acts and the dialectic of unilateral acts of the different States constitute an important source of international law.
RÉSUMÉLe début de ce cours est consacré à la question de l’existence même du droit international, à sa définition et à ses fondements, ainsi qu’à la notion de la souveraineté internationale. Le cours continue sur la dynamique conventionnelle du droit international par une étude de l’évolution du régime juridique international des traités et de la créativité du droit conventionnel. Les études des instruments du droit international, à savoir la coutume, les actes unilatéraux, mais aussi la normativité juridique internationale avec notamment la question du jus cogens et des obligations juridiques internationales permettent de mieux comprendre la vision du Professeur sur le droit international. Enfin, une analyse de la Charte des Nations Unies, à la fois comme un ensemble normatif et comme une matrice institutionnelle est donnée. Cette analyse est suivie d’une explication sur les différentes formes que prend l’interprétation, pour conclure sur la question : « Sur quoi repose la créativité du droit international ? ».
